Earlier this month, The Banker magazine published an article by three lawyers from Slaughter & May listing key issues for banks to look out for in 2023. The areas listed were Competition class actions; Securities litigation; Duties to customers; Russia sanctions; increasing levels of Insolvencies; Financial technology; and Climate litigation.
The majority of these will already be familiar to anyone involved in financial sector litigation. We have provided experts in many cases in the first six categories and are well positioned to identify appropriate experts for climate-related litigation, since our sister company GBRW Consulting is seeing increasing numbers of engagements for banks, regulators and Governments involving climate and sustainability financing.
On the issue of financial technology, our newsletter this month carries an article on Digital Assets by Dr Ian Hunt.
Ian discusses different categories of digital assets and comments on some of the ways in which actual experience may deviate from expected outcomes. His comments on the contrast between the legal frameworks governing tangible and digital assets are particularly relevant to past and potential disputes.
Our second article comments on the less esoteric, but no less important, issue of the relationship between insured parties, insurers and insurance brokers. Grahame Pipe has over 40 years' experience in broking, underwriting and underwriting consultancy and shares practical advice on how to avoid problems which may only come to light when a claim is made. Insurance disputes consistently make up around a third of our engagements, demonstrating the importance of the issues which Grahame discusses.
